Terms of Service
Effective April 30, 2026
These Terms of Service (“Terms”) are a binding agreement between you and ArkiQ Solutions LLC (“Trajecta,” “we,” “us,” or “our”), the company that operates the Trajecta website at jointrajecta.com, the Trajecta mobile application, and related services (collectively, the “Service”). By creating an account, installing the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. If you are between 16 and 18, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. The Service is not intended for children under 16, and we do not knowingly collect data from them.
2. Your account
You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us at team@jointrajecta.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that pose a risk to the Service or other users.
3. The Service is not medical advice
Trajecta produces diagnostic scores, training plans, and nutrition targets for general fitness purposes. It is not medical advice, medical diagnosis, or treatment. Consult a licensed physician before beginning any new training or nutrition program, particularly if you are pregnant, recovering from injury, managing a medical condition, or under 18. You assume all risk associated with physical activity, dietary changes, and decisions you make based on outputs from the Service.
4. Subscriptions, billing, and refunds
Some features require a paid subscription. Pricing, billing frequency, and trial terms are shown at the point of purchase. Subscriptions auto-renew until cancelled. You can cancel at any time through the platform you used to subscribe (e.g., Apple App Store, Google Play, or our web checkout). Cancellation stops future renewals; it does not retroactively refund the current billing period unless required by law or stated otherwise at purchase.
5. Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to extract source code, models, or training data from the Service;
- scrape, mass-download, or build a competing product using outputs from the Service;
- upload content that is unlawful, infringing, harassing, or that impersonates another person;
- interfere with the Service’s integrity, security, or availability, or attempt to access accounts or data that are not yours;
- use the Service to develop a model that competes with Trajecta.
6. Your content
You retain ownership of the data you submit (workout logs, body metrics, photos, written notes, etc.). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display this content solely to operate and improve the Service for you. We do not sell your personal data.
7. Third-party platforms
The Service may integrate with third-party platforms such as Apple Health, Google Fit, Stripe, Supabase, and TikTok. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party services.
8. Intellectual property
The Service, including its software, scoring methodology, copy, visual design, and the “Trajecta” name and logo, is the property of ArkiQ Solutions LLC and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes.
9. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms, if your use creates legal or security risk, or if we discontinue the Service. On termination, the sections that by their nature should survive (ownership, disclaimers, limitation of liability, governing law) will continue to apply.
10. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that scores and recommendations will produce a particular result.
11. Limitation of liability
To the fullest extent permitted by law, ArkiQ Solutions LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) US $100.
12. Indemnification
You agree to indemnify and hold harmless ArkiQ Solutions LLC from any claim or demand, including reasonable attorneys’ fees, arising out of your use of the Service, your content, or your violation of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to that jurisdiction. You and we each waive any right to a jury trial.
14. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or in the app. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
